Incidents - Gender

March 20, 2008

Incident:  A student reported that she was the victim of sexual misconduct by a non-student .  The victim alleged she was inappropriately touched in a women's bathroom in downtown Granville while she was incapable of giving consent.

Action Taken:  The student reported the incident to Campus Security.  The student also filed a report with the Granville Police Department.

Status:  Under investigation by the Granville Police Department.

March 5, 2008

Incident: Two students have reported they were victims of sexual assault by the same student in Fall of '04. One student reported non-consensual sex. And the other student reported inappropriate sexual touching without her consent.

Action Taken
: The Office of Security and Safety prepared a community alert about the incident.

Status: The victims are considering their options. The incident remains open.

Status (3/14/08):  Conduct charges have been issued to the student regarding one of the reported incidents and the student shall be summoned into the community rights and standards process.

Status (3/17/08):  The conduct charges filed were misnoted on this climate page and are not associated with either of the cases noted above.  The charges apply to an incident that occurred 9/22/05 (see below).  These incidents remain open and the victims are considering their options.

February 28, 2008

Incident:  A student has reported to the Office of Campus Safety and Security that she was a victim of a sexual assault by a student known to her in Fall 2004.  The victim was asleep in her room when the suspect entered the room and allegedly attempted to have sex with her while she was incapable of giving consent.

Action Taken:  The Office of Safety and Security prepared a community alert about the incident.

Status:  The victim is considering her options at this time.  The incident remains open.

Status (3/14/08):  Conduct charges have been issued to the student and the student will be summoned into the community rights and standards process.

Status (3/17/08):  The charges against the student have been withdrawn as insufficient information is available at this time to proceed with adjudication of the matter through the community rights and standards process.  Charges could be filed again in the future as is reasonable and feasible.  The case remains open.

February 15, 2008

Incident:  A student has reported that two other students were victims of sexual assault by the same student in October of ’07 and December of ’07. The suspect allegedly had sex with both women while they were incapable of giving consent.  The victims have not come forward at this time.

Action Taken:  The Office of Security and Safety prepared a community alert about the incident. Steps are being made to contact the alleged victims.

Status:
  Under investigation by the Office of Security and Safety.

January 22, 2008

Incident:  A student recently reported that she was a victim of a sexual assault that occurred in March of 2005.  The suspect, who is currently a student, allegedly got in bed with the victim and fondled her breasts while she was incapable of giving effective consent.

Action Taken:  The Office of Security and Safety interviewed the student victim and prepared a community alert about the incident.

Status:  Under investigation by the Office of Security and Safety.

Status (3/14/08):  Conduct charges have been issued to the student and the student shall be summoned into the community rights and standards process.

Status (4/29/08):  Following a hearing before the Community Rights and Standards Board, the student was found responsible for sexual misconduct and placed on Disciplinary Probation through May 2008 and the student was restricted from participating in Commencement exercises and Senior Week Activities.

Status (5/8/2008):  After consideration of the student's appeal, the Appeals Board upheld the original decision from the Community Rights and Standards Board.  The restrictions noted in the 4/29/08 update were imposed immediately, the student was issued a no trespass directive and would face arrest by local law enforcement if present on campus.

December 15, 2007

Incident:  While investigating a concern, Security determined that a male student had sex with a female student acquaintance when she was allegedly incapable of providing effective consent.  The Granville Police were notified as was the emergency rescue squad.

Action Taken:  After investigating the incident, the University determined there was sufficient information to support that sexual misconduct may have occurred.  The incident was referred to the community rights and standards process.

Status:  The case has been heard by the Community Rights and Standards Board.  A decision is pending.

April 19, 2006

Incident: A female student reported non-consensual sexual activity with a male acquaintance in her residence hall room during the previous week.
Action Taken: The female student is pursuing legal action. She is not pursuing university action.
Status: Pending.

Fall, 2005

Incident: A female student reported unwanted sexual contact with a male acauaintance in his residence hall room during the fall 2005 semester. The report came to the University in March 2006.
Action Taken: The female student reported the incident to the Granville Police Department and is not pursuing University action at this time
Status: Pending.

November 6, 2005

Incident: A female student reported that a male acquaintance entered her residence hall room and touched her, without consent, while she slept.
Action Taken: The female student pursued formal disciplinary action. The Community Rights and Standards Board found the male student responsible and placed him on Disciplinary Suspension for spring semester 2006, required an alcohol assessment, counseling, and issued a No Contact Directive should the male be reinstated after his semester of Suspension.
Status: Completed.

October 1, 2005

Incident: A female student reported unwanted, sexual intercourse with a male acquaintance in his residence hall room.
Action Taken: The female student is pursuing formal campus conduct action and has reported the incident to the police.
Status: The male student withdrew prior to the filing of charges and a no trespass directive was issued to him by the university.

September 25, 2005

Incident: A female student informed the university that she may have had nonconsensual sexual interaction with one or two male acquaintances.
Action Taken:The female student reported the alleged incident to the police. Evidence collected by the police did not confirm that the female student was subjected to nonconsensual sexual contact.
Status:Completed.

September 22, 2005

Incident: A female student reported being kissed and touched, without consent, in her residence hall room by a male acquaintance.

Action Taken: The female student is determining a course of action at this time.

Status: Case is pending.

Status (3/17/08): Conduct charges have been issued to the student regarding the reported incident and the case shall be adjudicated through the community rights and standards process.  Additionally, the victim/survivor has reported new allegations.

December 3, 2004

Incident: A female student reported being sexually assaulted in a common area of her residence hall by a male acquaintance.
Action Taken: The Judicial Council found the male student responsible for sexual assault and placed him on Disciplinary Suspension through the spring of 2006.
Status: Closed.

September 7, 2004

Incident: A female student reported being sexually assaulted by a male acquaintance in her residence hall room.
Action Taken: The female student reported the incident to the local police.
Status: Anyone with information is encouraged to contact Garret Moore, Chief of Campus Safety and Security at ext. 6482, or Sarah Westfall, Dean of Students at ext. 6271.

Late April, 2004

Incident: Two female students separately reported alleged sexual assaults by the same male acquaintance in his residence hall room. One incident occurred in January and one occurred in April.
Action Taken: The male student was placed on an interim suspension pending the outcome of the judicial cases brought by the women students. The Judicial Council found the male student responsible for sexual assault in one of the cases and placed him on Disciplinary Expulsion.
Status: Completed.

Late March/early April, 2004

Incident: A female student reported being sexually assaulted in her residence hall room by a male acquaintance.
Action Taken: The female student verbally reported the incident to the university and is considering her campus and legal options.
Status: Update May 28, 2004: Both students graduated in May 2004. Case is closed.
